New Hyper with crash damage???
I bought a new (supposedly) Hyper 796 a few weeks ago and I'm finding some crash damaged parts on it. The clutch lever has some road rash/scrapes on it and the left handguard would not stay in place. Went to dealer and they claimed the clutch lever was damaged in the crate. They replaced it and have ordered a new handguard for the left side. I get home and discover that the left tank cover also has some road rash/scrapes on it. They tell me one is on backorder.
I'm not sure what I can do other than have the dealer replace the damaged parts.
I thought I was buying a new bike...

Maybe another dealer could run the VIN through DNA and see if there is a story behind it.
If they are ordering parts for you without questioning YOU as to why these parts are damaged, I think they know more than they are letting on.

How many mile was on it when you got it? Don't take it the wrong way, but this is stuff you should have noticed before you left the dealer. Glad to hear they are sorting it out, but yeah I'd expect a NEW bike if that's what I was buying.

These are things you need to check before you buy the bike, unless you bought out of state or something like that.

+1! It was likely laid down by a customer during a test ride, or somebody knocked it over accidentally. Dealership replaced obvious damage, and hoped the buyer didn't notice the rest.

What if it is laid down by a customer?
I find it kinda nasty to sell it as new for full price without telling the customer.
All sorts of parts can be damaged and break prematurely after a crash.
If this was in Sweden all hell would break loose if the customer found out the dealer was trying to hide it. :P

This is a very good point
No dealer wants this sort of press, I think its time you got an exhaust or something substantial in the least.
They never should have let it leave the showroom floor given they knew it was damaged or should of at least mentioned it to you and offered a decent discount because of it.
Buying a knew bike is exciting and an easy time to totally not see things liek this on pick up.

Could be a salespersons or a mechanics or the shops girl fridays mistakes while moving it about the shop or an unsupervised coustomers mistake...
The New Multi on the dealer flooe has a 1-1/2" paint gouge in the left pannier due to someones Footwear decoration or zipper caused while mounting or dismounting...
Doesn't take much to do some damage...
Sure you didn't do it yourself?????

Seems to me if the clutch lever has road rash scrapes on it, the damaging
surface had to go through the handguard to get there. The OP already stated the
left handguard is not staying in place properly, another indicator that it was
replaced, perhaps poorly, after being damaged. Would be tough to damage
the clutch lever with that hand guard in place, plus add in the scrapes on the
left fairing, and it seems like the bike was dropped or at least knocked over on
a paved surface.
A similar story happened to me-- bought a brand new car, got it home, went to
pull off the front license plate "dealer" frame, and discovered that the front end
had been re-painted (and not to factory quality). It went back the next day and
I got another car, same model, same color. Salesman said another dealer had the
car first and scratched the front end while it was in the lot... should have been
disclosed to the buyer before he takes it home.

Every dealer in every state that I have ever heard of is bound by "Full Disclosure" laws. This goes with vehicles and real estate.
Once you prove it, you have options and the dealer is screwed.....unless he plays.
The mere threat of getting the DMV involved may settle this situation to your satisfaction.
