Yes, it can and should be removed (weight/airflow/sound, etc). A full system, like the Zard collectors, replaces the stock "S" pipe and removes the flapper valve assembly entirely. If you don't have a DP ECU (from 2-1 or 2-2 Termi kit), you will get a DTC error after you remove the butterfly valve - motocreations offers a reasonably priced solution, which fixes the CEL error and lets you remove the funky actuator thingy under the seat :

If you have a DP ECU, the butterfly valve is already inactivated and you shouldn't receive an error code after it is removed.
