Parts Transaction Gone Bad. Buyer beware of Montducati
Sorry for the long post, but I want to make sure people are away of a less than satisfactory parts transaction.
I bought a set of Desmotimes axle sliders from a guy on the Ducati.ms forum. The ad said the axle plates were for ST3S. Just to be sure I asked if these would fit an aluminum swingarm. He stated, "I purchased them for my ST3S, which has an alum swing arm. That's the best I can tell you."
When I received them they did not fit an aluminum swingarm (I checked against a couple of bikes including an ST3S and two Monsters with aluminum swingarms including my own). However, these did fit on a steel swingarm of a Monster 695. So I wrote the guy back and asked to send these back and be reimbursed.
He wrote back, "I will only issue a refund if they are unopened in their original package. Please don't send them back if they have been opened as I will not issue a refund. Cheers"
So I wrote back again, "The package was opened. That is how we discovered these do not fit an aluminum swingarm as advertised. It sounds like you are trying to avoid responsibility for misrepresenting these axle plates. I'm sure it was an accident, but these axle plates are not what you stated them to be in your advertisement. Only one side was opened and the plastic was opened along the seam. If you want to reseal the package that will not be hard to do. Will you accept responsibility for these plates and reimburse the $60. I'm willing to pay for return shipping. "
Then he stated, "I did not misrepresent, I purchased them new from Desmtimes for my ST3s and the plates you have are what they sent me. I will accept them if they are in new condition minus my shipping cost."
I then wrote back and said I did not want to pay for his shipping and my return shipping to him. I just wanted my full $60 reimbursed. He hasn't written back for several days effectively sticking me with his mistake. I shouldn't have to be the one to educate this guy on how to do business properly. If the shoe was on the other foot, I would be falling all over myself trying to make this right. I realize it was a minor mistake and could of happened to anyone, but not fixing it is what I have a problem with. Again buyer beware.

That does sound like a crappy deal. If someone selling something STATES that it will fit what you are asking, it is on them. I can understand a misunderstanding, but to ask a direct question on fitment and be lied to is fraud.

if he actually bought from Desmotimes and has all the shipping and order materials, he should contact them for a replacement, have them sent to you and return the old ones to Desmo. They may have made a mistake at DT and i feel they are responsible for the mixup. YOu were probably not misled, but just the victim of a DT foulup, the guy selling the stuff to you perhaps honestly believing he had the right sliders.

I agree with your first sentence. However, I don't think I was mislead. He thought he had the part he was advertising, although it would have been an easy thing for him to check before shipping. My issue is how he is not handling what should be a minor issue.

I just noticed this thread and find it very amusing. If any of you have purchased parts from me you know I am 100% legit. I have never had anyone complain or write a negative thread about a purchase they made from me prior to this.
I did purchase the plates from Desmotimes and they were for my ST3S. I decided to sell the bike prior to installing the plates so if they are not for the ST3S I had no idea.
Everything the purchaser wrote is true, my bad for thinking he would absorb the original $5.00 shipping cost for something I had no control over. Considering he did open the package, depreciating the value I thought I was being fair. I told him I would refund his money; however, because he did not want to sacrifice a cup of Starbucks Coffee he decided not to return them and smear my name.
If you view my current listings on ebay you'll see I have 357 transactions with a 100% rating, I think that speaks for itself.
Travman - if it makes you feel better I will refund the entire $60, mission accomplished.

Glad Trav got the resolution needed. I don't know the seller, but I can say that through multiple interactions and transactions, Trav has always been a stand up guy.
I think the seller can rest assured that everyone knows it was a one time misunderstanding. This sort of thing happens to all of us at some point and then its forgotten. I'm certain there was no smearing that will every tarnish his future reputation...

Perhaps there is a part # that both parties should research and make sure they are buying/selling the correct part.
Seems simple enough to do a little research to avoid confusion...

Then mission accomplished. Rob, you tarnished your own name by making the man come on here and call you out. You would have kept the shipping and "found it all amusing" if he hadn't posted up. Since you are so fair to your 357 other customers, why would you push this guy around for a cup of Starbucks?
